Depuis le d\u00e9clenchement de l\u2019affaire Cambridge Analytica, Mark Zuckerberg pense beaucoup de bien du RGPD, le R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es.<\/p>\n\n\n\n<p>Jadis honni, ce texte europ\u00e9en, adopt\u00e9 en 2016, qui renforce les standards de la vie priv\u00e9e des Europ\u00e9ens sur internet, sera m\u00eame pour Zuckerberg le standard de r\u00e9f\u00e9rence pour ses 2,3 milliards d\u2019utilisateurs.<\/p>\n\n\n\n<p>Bruxelles peut se r\u00e9jouir de ce retournement de veste, car Facebook et les autres g\u00e9ants du num\u00e9rique ont combattu des dispositions de ce texte, comme le consentement explicite que les utilisateurs doivent donner pour exploiter leurs donn\u00e9es ou encore la mise en place d\u2019amendes pouvant aller jusqu\u2019\u00e0 4&#160;% du chiffre d\u2019affaires pour les r\u00e9calcitrants. Mais si l\u2019UE gonfle les muscles sur l\u2019impact mondial du RGPD, seulement trois pays (Allemagne, Autriche et Slovaquie) l\u2019ont transpos\u00e9 int\u00e9gralement dans leurs l\u00e9gislations nationales, alors qu\u2019il entrera officiellement en vigueur le 25 mai 2018. Cela signifie que beaucoup d\u2019entreprises et administrations publiques ne seront probablement pas pr\u00eates \u00e0 cette date butoir. Le test d\u00e9sormais pour les Europ\u00e9ens est donc de bien appliquer leurs propres textes afin que Washington et d\u2019autres pays s\u2019en inspirent pour renforcer la vie priv\u00e9e dans un monde de plus en plus digital.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Perspectives&#160;: <\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Le 12 avril, la Cour de Justice de l\u2019Union europ\u00e9enne a \u00e9t\u00e9 saisie d\u2019une question pr\u00e9judicielle de la Haute Cour Irlandaise sur le \u2018<em>Privacy Shield<\/em>\u2019, l\u2019accord entre l\u2019UE et les Etats-Unis sur le transfert des donn\u00e9es des deux c\u00f4t\u00e9s de l\u2019Atlantique. Si jamais les juges europ\u00e9ens estiment que cet accord peine \u00e0 respecter les standards europ\u00e9ens de la vie priv\u00e9e, ces derniers peuvent tout \u00e0 fait le retoquer.
