C\u2019est le titre d\u2019un communiqu\u00e9 de presse relay\u00e9 par le collectif \u00ab&#160;Archives \u00e7a d\u00e9bloque&#160;\u00bb, principalement compos\u00e9 d\u2019historiens et d\u2019archivistes, qui d\u00e9nonce les restrictions d\u2019acc\u00e8s qui p\u00e8sent sur certaines archives contemporaines. Dans la nuit du 29 au 30 juin, le S\u00e9nat a finalement adopt\u00e9 l\u2019article 19 du projet de loi relative \u00e0 la pr\u00e9vention des actes de terrorisme et au renseignement, interdisant de fait l\u2019acc\u00e8s \u00e0 certaines archives, jusqu\u2019ici accessibles.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"fr\" dir=\"ltr\">\u26ab Nuit noire sur les <a href=\"https:\/\/twitter.com\/hashtag\/archives?src=hash&amp;ref_src=twsrc%5Etfw\">#archives<\/a>. (@ArchiCaDebloque) <a href=\"https:\/\/twitter.com\/ArchiCaDebloque\/status\/1410130426459525120?ref_src=twsrc%5Etfw\">June 30, 2021<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<ul class=\"wp-block-list\"><li>Les archives class\u00e9es secret-d\u00e9fense (les documents concernant les sites sensibles, le mat\u00e9riel de guerre, les armes de dissuasion et les techniques de renseignement) se trouvent au c\u0153ur de cette pol\u00e9mique, puisque c\u2019est l\u2019\u00e9quilibre entre leur d\u00e9lai de communication et les r\u00e9gimes d\u2019exceptions qui a \u00e9t\u00e9 fortement perturb\u00e9, causant un acc\u00e8s tr\u00e8s difficile, voire une incommunicabilit\u00e9 de documents dans certains cas.<\/li><li>Jusqu\u2019ici, ces archives sensibles \u00e9taient d\u00e9classifi\u00e9es dans un d\u00e9lai pr\u00e9vu entre 50 et 100 ans suivant leur production, selon leur niveau de sensibilit\u00e9. Or, en s\u2019appuyant sur l\u2019instruction g\u00e9n\u00e9rale interminist\u00e9rielle (IGI) 1300 (dont la pr\u00e9c\u00e9dente version \u00e9tait entr\u00e9e en vigueur le 30 novembre 2011), les pouvoirs publics ont d\u00e9cid\u00e9 de modifier la communicabilit\u00e9 des archives en exigeant que chaque document soit d\u00e9classifi\u00e9 un par un, cr\u00e9ant par cons\u00e9quent une situation d\u2019engorgement.<\/li><li>En France, l\u2019acc\u00e8s aux archives est un droit constitutionnel depuis 2017, consacr\u00e9 par une d\u00e9cision du Conseil constitutionnel (d\u00e9cision n\u00b0 2017-655 QPC du 15 septembre 2017) s\u2019appuyant sur l\u2019article 15 de la D\u00e9claration de 1789 (\u00ab&#160;La soci\u00e9t\u00e9 a le droit de demander compte \u00e0 tout agent public de son administration&#160;\u00bb). Les raisons invoqu\u00e9es pour ce resserrement du droit de la consultation d\u2019archives sont assez floues. Le minist\u00e8re des Arm\u00e9es invoque la protection des personnes concern\u00e9es par des archives secret d\u00e9fense, ainsi que des archivistes et historiens consultant ces documents.<\/li><li>L\u2019enjeu est de taille, puisque cette nouvelle interpr\u00e9tation de l\u2019IGI portant sur la protection du secret de la d\u00e9fense nationale a pour cons\u00e9quences de bloquer un grand nombre d\u2019historiens et d\u2019\u00e9tudiants travaillant sur des archives qui, jusqu\u2019\u00e0 la fin de l&rsquo;ann\u00e9e 2019, \u00e9taient communicables.
