{"id":106250,"date":"2021-04-21T10:55:03","date_gmt":"2021-04-21T08:55:03","guid":{"rendered":"https:\/\/legrandcontinent.eu\/fr\/?p=106250"},"modified":"2021-04-24T12:56:59","modified_gmt":"2021-04-24T10:56:59","slug":"feu-vert-de-la-cour-constitutionnelle-allemande-pour-la-ratification-de-la-decision-ressources-propres","status":"publish","type":"post","link":"https:\/\/legrandcontinent.eu\/fr\/2021\/04\/21\/feu-vert-de-la-cour-constitutionnelle-allemande-pour-la-ratification-de-la-decision-ressources-propres\/","title":{"rendered":"Feu vert de la Cour constitutionnelle allemande pour la ratification de la d\u00e9cision ressources propres"},"content":{"rendered":"\n<ul class=\"wp-block-list\"><li>Dans une ordonnance publi\u00e9e le 26 mars, la Cour Constitutionnelle allemande avait suspendu la derni\u00e8re \u00e9tape qui doit permettre la ratification de la d\u00e9cision ressources propres par l\u2019Allemagne, \u00e0 savoir la promulgation de la loi par le pr\u00e9sident Frank-Walter Steinmeier initialement pr\u00e9vue pour le 27 mars.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Cette d\u00e9cision \u00e9tait survenue juste apr\u00e8s le feu vert donn\u00e9 par le pouvoir l\u00e9gislatif, \u00e0 la suite d\u2019un recours d&rsquo;urgence contre la d\u00e9cision sur les ressources propres d\u00e9pos\u00e9 entre autres par un groupe de citoyens eurosceptiques pr\u00e9sid\u00e9 par le cofondateur du parti Alternative f\u00fcr Deutschland (AfD).<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Ce blocage aurait pu consid\u00e9rablement retarder le processus de ratification et le d\u00e9ploiement du fonds de relance Next Generation EU, notamment si la Cour constitutionnelle allemande avait d\u00e9cid\u00e9 de renvoyer l&rsquo;affaire devant la Cour de justice de l\u2019Union europ\u00e9enne avant de se prononcer sur le recours.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Lors<strong> <\/strong>d&rsquo;une <a href=\"https:\/\/www.pscp.tv\/ilGC_\/1kvJpoWWvQZGE?t=58m44s\">table ronde<\/a> d\u2019<em>il<\/em> <em>Grand Continent, <\/em>Marco Buti, chef de cabinet de Paolo Gentiloni, d\u00e9clarait avoir re\u00e7u des assurances de la part du gouvernement allemand qui s&rsquo;estimait suffisamment arm\u00e9 pour faire valoir ses arguments devant la Cour de Karlsruhe.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Ce mercredi 21 avril, la <em>Bundesverfassungsgericht<\/em> a rejet\u00e9 le recours d\u2019urgence contre l\u2019ex\u00e9cution de la loi, ouvrant ainsi la voie \u00e0 sa ratification formelle par le pr\u00e9sident. Si la Cour n\u2019a pas encore jug\u00e9 l\u2019affaire sur le fond, elle permet l&rsquo;application du m\u00e9canisme au regard des cons\u00e9quences potentiellement &lsquo;irr\u00e9versibles&rsquo; d&rsquo;un report de l&rsquo;entr\u00e9e en vigueur. En effet, par cette d\u00e9cision, la Cour consid\u00e8re que les inconv\u00e9nients, au regard de l&rsquo;objectif de politique \u00e9conomique, sont &lsquo;moins dramatiques&rsquo; si la demande de suspension en urgence est rejet\u00e9e (et que le m\u00e9canisme est \u00e9ventuellement jug\u00e9 inconstitutionnel dans un deuxi\u00e8me temps) que si celle-ci est approuv\u00e9e mais que le verdict final confirme la constitutionnalit\u00e9 de la d\u00e9cision ressources propres. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>La date \u00e0 laquelle la Cour constitutionnelle entend se prononcer sur le fond n&rsquo;a pas \u00e9t\u00e9 annonc\u00e9e mais elle justifie sa d\u00e9cision d&rsquo;aujourd&rsquo;hui sur la base d&rsquo;un &lsquo;examen sommaire&rsquo; qui ne pr\u00e9sage pas &lsquo;une forte probabilit\u00e9 de violation&rsquo; de la responsabilit\u00e9 budg\u00e9taire du <em>Bundestag<\/em>, notamment dans la mesure o\u00f9 le m\u00e9canisme limite l&rsquo;exposition budg\u00e9taire des \u00c9tats membres qui ne sont pas directement responsables de la dette contract\u00e9e par l&rsquo;Union &nbsp;<span class='whitespace-nowrap'><span id='easy-footnote-1-106250' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote note-digits-1'><a href='https:\/\/legrandcontinent.eu\/fr\/2021\/04\/21\/feu-vert-de-la-cour-constitutionnelle-allemande-pour-la-ratification-de-la-decision-ressources-propres\/#easy-footnote-bottom-1-106250' title='&lt;a href=&quot;https:\/\/www.bundesverfassungsgericht.de\/SharedDocs\/Pressemitteilungen\/EN\/2021\/bvg21-029.html&quot;&gt;https:\/\/www.bundesverfassungsgericht.de\/SharedDocs\/Pressemitteilungen\/EN\/2021\/bvg21-029.html&lt;\/a&gt; (points 2a et b)'><sup>1<\/sup><\/a><\/span><\/span>.<\/li><\/ul>\n\n\n\n<div class=\"iframe-container wp-block-image wp-block-image-large  iframe-dw\">\n\t<div>\n\t\t<iframe class=\"absolute w-full h-full pin-t pin-l\" title=\"titolo\" aria-label=\"Interactive line chart\" src=\"\/\/datawrapper.dwcdn.net\/zmaP4\/3\/\" scrolling=\"no\" frameborder=\"0\"><\/iframe>\n\t<\/div>\n<\/div>\n\n\n\n<ul class=\"wp-block-list\"><li>\u00c0 ce jour, 18 \u00c9tats-membres ont ratifi\u00e9 la d\u00e9cision ressources propres qui autorise la Commission \u00e0 emprunter les sommes destin\u00e9es \u00e0 financer les d\u00e9penses du plan de relance Next Generation EU. Le 14 avril, Johannes Hahn, le commissaire europ\u00e9en au Budget a pr\u00e9sent\u00e9 la strat\u00e9gie de financement qui permettra de lever jusqu&rsquo;\u00e0 800 milliards d&rsquo;euros sur les march\u00e9s des capitaux en prix courant jusqu&rsquo;en 2026. Selon la Commission, cela se traduira par des volumes d&#8217;emprunts d&rsquo;environ 150 milliards d&rsquo;euros par an en moyenne, ce qui fera de l&rsquo;Union l&rsquo;un des principaux \u00e9metteurs en euros. Les emprunts devront \u00eatre rembours\u00e9s au plus tard en 2058&nbsp;<span class='whitespace-nowrap'><span id='easy-footnote-2-106250' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote note-digits-1'><a href='https:\/\/legrandcontinent.eu\/fr\/2021\/04\/21\/feu-vert-de-la-cour-constitutionnelle-allemande-pour-la-ratification-de-la-decision-ressources-propres\/#easy-footnote-bottom-2-106250' title='&lt;a href=&quot;https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/fr\/ip_21_1703&quot; target=&quot;_blank&quot; rel=&quot;noreferrer noopener&quot;&gt;https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/fr\/ip_21_1703&lt;\/a&gt;'><sup>2<\/sup><\/a><\/span><\/span>. La Commission s&rsquo;attend \u00e0 ce que les 27 \u00c9tats membres concluent la ratification avant l\u2019\u00e9t\u00e9.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>En parall\u00e8le, les versions d\u00e9finitives des plans nationaux qui conditionnent l&rsquo;octroi des subventions du plan de relance doivent \u00eatre progressivement livr\u00e9es \u00e0 la Commission tout au long du mois d\u2019avril. Si aucun pays n&rsquo;a formellement pr\u00e9sent\u00e9 sa copie, la Commission et les \u00c9tats membres sont en n\u00e9gociation depuis plusieurs mois bien que certains pays aient d\u2019ores et d\u00e9j\u00e0 indiqu\u00e9 qu\u2019ils ne tiendraient pas la date limite initialement fix\u00e9e au 30 avril. A cet \u00e9gard, des \u00c9tats membres font actuellement pression sur la Commission europ\u00e9enne pour r\u00e9duire la p\u00e9riode d&rsquo;\u00e9valuation de leurs plans afin de d\u00e9bloquer les fonds rapidement. Selon la proc\u00e9dure, la Commission dispose d\u2019une p\u00e9riode de deux mois pour se prononcer sur les plans nationaux, tandis que le Conseil dispose d\u2019un mois suppl\u00e9mentaire. Tr\u00e8s politique, la s\u00e9quence d\u2019\u00e9valuation et d\u2019approbation de ces plans sera \u00e0 suivre de
