{"id":99738,"date":"2026-05-19T13:01:20","date_gmt":"2026-05-19T11:01:20","guid":{"rendered":"https:\/\/legrandcontinent.eu\/es\/?p=99738"},"modified":"2026-05-19T13:01:24","modified_gmt":"2026-05-19T11:01:24","slug":"openai-lecciones-una-victoria-por-defecto","status":"publish","type":"post","link":"https:\/\/legrandcontinent.eu\/es\/2026\/05\/19\/openai-lecciones-una-victoria-por-defecto\/","title":{"rendered":"OpenAI: las lecciones de una victoria por defecto"},"content":{"rendered":"\n<p>As\u00ed, el gran juicio sobre la IA, la batalla \u00e9pica \u2014o m\u00e1s bien shakespeariana\u2014 entre el hombre m\u00e1s rico del mundo, Elon Musk, y Sam Altman, el tambi\u00e9n mil millonario fundador de OpenAI, ha resultado ser un gran revuelo para nada.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tras un juicio de tres semanas \u2014relativamente breve para los Estados Unidos\u2014, un jurado un\u00e1nime dict\u00f3 en menos de dos horas un veredicto que desestimaba la demanda de Musk por prescripci\u00f3n, veredicto consultivo que la jueza federal Yvonne Gonz\u00e1lez Rogers se apresur\u00f3 a adoptar.<\/li>\n<\/ul>\n\n\n\n<p>Aunque sab\u00eda desde al menos 2021 del giro comercial de OpenAI, su antiguo inversor y ahora competidor, Elon Musk, esper\u00f3 demasiado para presentar una demanda.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De este modo, la resoluci\u00f3n de car\u00e1cter t\u00e9cnico evita pronunciarse sobre las cuestiones jur\u00eddicas planteadas por el demandante: \u00bfSe hab\u00eda comprometido OpenAI contractualmente con Musk a seguir siendo una fundaci\u00f3n sin \u00e1nimo de lucro? \u00bfHa sobrepasado su objeto social al transformarse en una empresa comercial?<\/li>\n<\/ul>\n\n\n\n<p>No es de extra\u00f1ar que estas preguntas hayan quedado sin respuesta, ya que parecen insignificantes ante la evidente mala fe de ambos protagonistas, enzarzados en una carrera desenfrenada por el dominio de la tecnolog\u00eda potencialmente m\u00e1s poderosa de la historia de la humanidad, mientras ambos pretenden buscar \u00fanicamente el bien de esta.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Es cierto que Altman es el gran beneficiario de una decisi\u00f3n que supone, ante todo, una derrota para su adversario, pero su reputaci\u00f3n, la imagen de OpenAI y sus pretensiones humanistas no salen reforzadas de este juicio, emblem\u00e1tico del naufragio moral de Silicon Valley.<\/li>\n\n\n\n<li>Si hay una conclusi\u00f3n que sacar de todo esto, es que dejar una tecnolog\u00eda tan revolucionaria y potencialmente destructiva en manos de un pu\u00f1ado de empresarios movidos \u00fanicamente por su desmesurada ambici\u00f3n, o incluso por una codicia sin l\u00edmites, resulta cada vez m\u00e1s irresponsable e insostenible.<\/li>\n\n\n\n<li>La inteligencia artificial no puede prescindir del mercado debido a las colosales inversiones que requiere, pero tampoco puede prescindir de la regulaci\u00f3n y la gobernanza p\u00fablica debido a las cuestiones existenciales que plantea.<\/li>\n\n\n\n<li>La carrera por la innovaci\u00f3n, sin m\u00e1s l\u00edmite que la conciencia ambigua y oportunista de sus impulsores, debe terminar.<\/li>\n<\/ul>\n\n\n\n<p>La victoria por defecto de OpenAI no hace m\u00e1s que acentuar esa necesidad y urgencia.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Como se\u00f1ala Max Tegmark: \u00abLa inteligencia artificial est\u00e1 menos regulada en Estados Unidos que los bocadillos. No se puede abrir una tienda de bocadillos sin que inspeccionen su cocina.
